Theme day 20 years ‘Journal of Construction Law and Real Estate’

Our expert on environmental law Ive Van Giel will speak about the expiry regime on environmental permits on 8 November 2022. Is the proverbial “spade in the ground” within two years of permit granting sufficient to stop the permit’s expiry?
 
Ive provides a current state of affairs from case law and tests it against concrete projects (relating to urban development acts (including changes of function), classified establishments or activities, land subdivision, retail activities, vegetation changes, etc.). Examples from other jurisdictions are also discussed. Finally, the question will be answered whether this sunset regulation (as stated by the decree maker) has “proved its soundness” or whether it has… passed its expiry date….
 
This session (11h30-13h) is part of the “anniversary study day” (with choice of sessions) for the 20th anniversary of the Tijdschrift voor Bouwrecht en Onroerend Goed, of which Ive is coordinator of environmental law as a member of the editorial board. This study day will take place at Salons Van Edel in Antwerp (Terbekehof 13).
